A CHARTER ORDINANCE EXEMPTING THE CITY OF BELLE PLAINE, KANSAS, FROM THE PROVISIONS OF ARTICLE 2, CHAPTER 15 OF KANSAS STATUTES ANNOTATED REGARDING THE ELIGIBILITY, APPOINTMENT, TERMS, VACANCIES AND REMOVAL OF CITY OFFICERS AND EMPLOYEES.

WHEREAS, the Council has found that the City may, pursuant to state constitutional authority, utilize its home rule powers to exempt itself from certain statutory provisions that do not apply uniformly to all cities; and that none of the current provisions of Article 2, Chapter 15 of Kansas Statutes Annotated, and more specifically K.S.A. 15-204 and15-209, apply uniformly to all cities; and that sufficient reasons exist to justify such exemption;

NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF BELLE PLAINE, KANSAS, that:

Section 1. The City of Belle Plaine, Kansas hereby elects to exempt and does exempt itself from all of the current provisions of Article 2, Chapter 15 of Kansas Statutes Annotated, and more specifically K.S.A. 15-204 and 15-209.

Section 2. The City of Belle Plaine, Kansas shall hire, compensate and retain all of its officers and employees pursuant to City guidelines, and amendments thereto, the City’s Uniform Personnel Policies and Guidelines Manual.
